POSITION STATEMENT OF PLAINTIFF MARK ALLEN TAYLOR

Pursuant to the Court's directive at the hearing held on January 26, 2007, Plaintiff Mark Allen Taylor submits his position statement as follows: 1. Mr. Taylor agrees with and supports the position of the Colorado Attorney

General that the protective order should be modified to allow access to the remaining evidence room materials by Dr. Elliott. Such access is in the public interest.

Plaintiff does not oppose the ultimate transfer of the evidence room

records - the deposition transcripts and their remaining exhibits - to the National Archives. 3. Plaintiff does oppose, however, sealing those records at the National

Archives for 25 years. The Court did not reveal its rationale for suggesting this time frame for a sealing order, but it does not appear consistent with applicable law, or the rationale underlying the initial protective order governing the evidence room. For example, if denying access to the public is based upon the fear of potential copycat crimes, that rationale does not extend to allowing access to Dr. Elliott. Nor is it apparent why total sealing for 25 years would serve this or any other interest. 4. The Court's concern about whether the deposition transcripts are

"records" under the Federal Records Act is addressed in the Attorney General's position statement. But even if the transcripts are not subject to that Act, the Court should not sanction destruction of the transcripts as contemplated by the Magistrate's order. The Tenth Circuit has recently reiterated that protective orders are subject to modification even after a case has been dismissed. Abraham v. Intermountain Health Care, Inc. , 461 F.3d 1249, 1268 (10th Cir. 2006). Obviously, if the records are destroyed, any later attempt to modify the protective order to gain access to the evidence room materials would be negated.
