PLAINTIFFS' MOTION IN LIMINE (Refiled in Part)

Plaintiffs Charles M. Kovacs, Christine H. Bukala, Danny M. Trammell, Robert C. McGrath and Joseph J. Ragusa respectfully move the Court to preclude Defendant The Hershey Company (Hershey) from presenting any argument or evidence at trial regarding "Defenses" 5, 13, 14 and 15 asserted by Hershey in the Final Pretrial Order. In support Plaintiffs state as follows: 1. On July 24, 2006 Plaintiffs filed Plaintiffs' Motion in Limine,

Document Number 383 (Limine Motion), arguing at pages 3 through 7, Sections B and C, that Hershey should not be allowed to present argument or evidence with respect to "Defenses" 5, 13, 14 and 15 Hershey asserted in the Final Pretrial Order, Document Number 371, at pages 9 through 11.

In the Court's June 22, 2007 Order, Document Number 528, at page

2, the Court provided that "the Plaintiffs may file motions in limine as to the issues raised in Paragraphs 1 of the Notice of Plaintiffs' Motions in Limine (if the issues were raised before Magistrate Judge Boland in connection with his approval of the Pretrial Order) and 2. Plaintiffs may incorporate by reference prior pleadings on the issues if desired." 3. Plaintiffs therefore incorporate pages 3 through 7, sections B and C,

of their Limine Motion, and consistent with the Court's directive, Plaintiffs reassert their arguments which were preserved before Magistrate Judge Boland at the Final Pretrial Order stage. See Final Pretrial Order p. 9 n. 12 (as to Defense 5); p. 10 n. 16 (as to Defense 13); p. 11 n. 17 (as to Defense 13); and p. 11 n. 18 (as to Defense 15). Request for Relief Wherefore, Plaintiffs respectfully request that the Court enter an order precluding Hershey from presenting any argument or evidence in support of Hershey's alleged Defenses 5, 13, 14 and 15.
