STIPULATION AND PROPOSED ORDER
WHEREAS, under the Court’s Scheduling Order dated November 6, 2006
(D1. 83) bifurcating the contract and patent infringement issues, discovery on the
I contract issues has been ccrnpieted and the time for tiling case dispositive motions on the
contract issues is at hand (see Stipulatien and Order dated May ll, 2007 (Di. 103));
WHEREAS, the parties have been discussing the resolution of this
litigation;
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by
and between the parties, subject to the approval of the Court, that the date for submission
of case dispositive motions on the contract issues shall be extended from June 4, 2007, to
be due g July 3, 2007. The remaining dates in the case schedule shall remain
. unchanged.
