hereby submit their Joint Notice of Appeal. Plaintiffs hereby appeal to the United States Court of Appeals for the Tenth Circuit from the November 16, 2006 order entitled Memorandum Opinion and Order Granting Defendants' Dispositive Motions re Athlete Claims ("Order"). Judgment entered pursuant to Rule 54(b) of the Federal Rules of Civil Procedure on January 10, 2007. In Civil Action No. 99-cv-2077-JLK, the Order granted the USOC's Motion for Summary Judgment on Plaintiff's Second and Third Claims for Relief and denied Plaintiff's Motion for Partial Summary Adjudication. In Civil Action No. 03-cv-1364-JLK, the Order granted Defendants' Motion to Dismiss Plaintiffs' ADA and Rehab Act Claims Pursuant to Fed. R. Civ. P. 12(b)(6). Plaintiff Shepherd hereby appeals the dismissal of Counts II and III of his Third Amended Complaint and Plaintiffs Hollonbeck, Iniguez, Heilveil, and Vie Sports Marketing, Inc., hereby appeal the dismissal of ClaimsI and II of their Amended Complaint.
