Dear Judge Robinson: On behalf of Syngenta Seeds, Inc., we write in response to Monsanto's letter of January 7, 2008. Monsanto ' s characterization of the Missouri action presents a misleading picture, as it neglects to mention that throughout the litigation there Syngenta has asserted that the patent in suit is invalid and unenforceable, that the Missouri court ' s claim construction in fact strengthens Syngenta ' s invalidity and fraud defenses , and that the court itself acknowledged that " Syngenta makes a number of strong arguments regarding enablement , and fraud , which will appropriately be addressed later in the litigation ." (Op. at 33.) Syngenta also disputes Monsanto ' s contention of the relevance of the Missouri action to the above -captioned antitrust case. As suggested by Monsanto, we will be prepared to discuss these matters at the next hearing, which the Court indicated would be scheduled following a ruling on Monsanto's motions for rehearing and rehearing en bane of the Federal Circuit's decision upholding this Court' s grant of summary judgment to Syngenta on the related patent case.
