COMES NOW PROBATION OFFiCER Max C Richards presenting an official report on James Brian Nardi who was
committed to the Bureau of Prisons on May 24, 2007 by the Honorable Susan R. Bolton presiding in the District Court of
Arizona. Aforty-eight (48) month period of supervised release was imposed, and supenrision commenced upon the offenders
discharge from imprisonment on October 3, 2007. In addition to the general terms and conditions adopted by the court, the
offender was ordered to comply with the following special conditions:
1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may
include testing for substance abuse. You shall contribute tothe cost of treatment in an amount to be detemlined by
the probation officer.
2. You shall submit your person, property, (including but not limited lo computer, electronic devices, and storage media),
residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable
manner. ‘
3. You shall provide the probation officer access to any requested financial information.
4. You are prohibited from owning, maintaining or using afirearm. g
5. You shall abstain from all alcohol or alcoholic beverages.
James Brian Nardi was convicted of armed bank robbery. a Ciass B felony. .
RESPECTFULLY PRESENTING FETITION FOR ACTION OF COURT FOR CAUSE AS FOLLOWS:
Allegatlon A: ylolgtlon of Standard Condition 1: “You shall not commit another federal, state, or local crime during the term
of supervision.' A grade C violation. §7B1.1{a)(3).
l Nardi introduced contraband, tobacco, info the Federal Correction Complex in Tucson, Arizona. between October 3, 2007, and
October 11, 2007. This is evidenced by tobacco seized by prison officials and by telephone conversations recorded by prison
officials. This is a violation of 18 U.S.C. 1791(d)(1)(F), a misdemeanor offense.
Allegation B: yjolgtion of Standard Qggdlttgg 10: “You shall not associate with any persons engage in criminal activity, and
shall not associate with any person convicted of a felony unless granted permission to do so by the probation officer.' A grade
C violation. §7B1.1(a)(3).
Between October 3. 2007, and October 11, 2007, Nardi conspired with Eddie Juszczak, lhhlliam Martin, to Nardi introduce
contraband, tobacco, into the Federal Correction Complex in Tucson, Arizona. This is evidenced by tobacco seized by prison
officials and by telephone conversations recorded by prison officials between Nardi and Juszczak and Martin. This is a violation
of 18 U.S.C. 1791 (d)(1 )(F}, a misdemeanoroffense. Both Juszczak and Martin were inmates at the Federal Correction Complex.

Juszczak was convicted in the District of Arizona of conspiracy to possess with intent to distribute cocaine and unlawful use
and carrying of firearm during a federal offense. He was sentenced to 202 months custody on Count 1 and 60 months to run
l consecutively on Count 4. Nardi had not been granted pemrission to associate with Juszczak or Martin
