of discovery from December 1, 2005 to March 1, 2006. The parties have exchanged numerous disclosure statements and have served and responded to written discovery. The parties have taken several depositions but there are some depositions that have not yet been scheduled. The parties are currently working on scheduling the remaining

depositions. The parties have also agreed to private mediation and would like to continue some discovery until after that mediation, should the mediation prove unsuccessful. While the parties will continue to conduct depositions and discovery during the continuance, they agree that postponing certain discovery until after the mediation will preserve resources that might be better used to facilitate a settlement of this lawsuit. The parties therefore request a short extension to complete discovery in case the mediation is unsuccessful.1 A proposed form of Order is provided for the Court' convenience. s DATED this 30th day of November, 2005. The parties have previously requested and received two brief extensions of time for discovery. On January 25, 2005, the Court ordered that the deadline for the taking of plaintiff' expert deposition be extended from February 11, s 2005 to February 18, 2005. On March 7, 2005, the Court extended the deadline for the disclosure of BNSF' expert s witnesses from March 4, 2005 to March 22, 2005.
