Pursuant to the Court' April 12, 2005 Revised Scheduling Order, the parties s jointly submit the following settlement status report. The parties have had preliminary discussions regarding settlement but decided that they needed to complete plaintiff' s deposition and the deposition of his disclosed expert in order to have a productive settlement conference. BNSF and Chemical Lime deposed the plaintiff on August 11, 2005. Despite their diligent efforts, the parties have not been able to complete the

deposition of plaintiff' liability expert. The parties have nevertheless committed to s participating in a private mediation and are finalizing the details for the mediation. The parties will notify the Court regarding the outcome of the mediation following its conclusion.
