I MOTION FOR RECONSIDERATION OF MOTION TO ENFORCE
2 SETTLEMENT AGREEMENT AND MOTION TO DISMISS PLAINTIFF’S
COMPLAINT

4 Defendant Joseph L. Williams ("Williams"), hereby moves this Court for a
5 Motion for Reconsideration pursuant to 59 (a)(2) & (e) of the Federal Rules of Civil
6 Procedure for Reconsideration of the Motion to Enforce Settlement Agreement and to
7 dismiss this action pursuant to Fed. R. Civ. P. l2(b)(1), l2 (b)(2) and 12 (b)(6).

9 Plaintiff fails to state claims for which relief can be granted and, in any event this
10 Court lacks jurisdiction to hear p1aintiffs’ claims. The reasons supporting this motion
ll are set forth in more detail in the accompanying Memorandum of Law and attached
*2 exhibits.

4 THEREFORE, defendant respectiiilly requests that the instant motion be

15 GRANTED and that this action be DISMISSED.
