16 Pursuant to this Court’s Order dated December 19, 2005, Best Western
17 International, Inc. ("Best Western”) and defendants Oasis Investments, LP and Richard
18 M. Knapp (collectively “Defendants") hereby file this Joint Status Report.
19 Since the Court granted Best Westem’s Motion for Partial Summary Judgment on
20 November 8, 2005, counsel for the parties have discussed the possibility of resolving this
21 matter as well as the matter pending before Judge Rosenblatt as Case No. CV-04-0l32-
22 PHX-PGR without the need for further litigation.
23 As recently as January 11, 2006 counsel for the parties conferred. However,
24 counsel for Defendants indicated that he was experiencing difficulty reaching his clients
25 to discuss opportunities for resolving these cases in greater detail. Consequently, efforts

1 to resolve these cases have stalled pending Defendants’ counse1’s opportunity to have a
2 meaningful discussion with Defendants.
3 Nevertheless, in light of the Court’s ruling granting its Motion for Partial Summary
4 Judgment as to Counts I & II ofthe Complaint, Best Western intends to file an application
5 for entry of judgment and lodge a form of judgment no later than Tuesday, January 17,
6 2006. Best Westem will then await word Hom Defendants’ counsel as to the resolution of
7 this action, and may dismiss the remaining claims against Defendants.
