COMES NOW the defendant Tye K. Sloniker, by and through undersigned counsel, and respectfully moves this Court for an Order continuing the Sentencing in this matter. Sentencing is currently set for October 10, 2006 at 1:30 p.m. Counsel undersigned will be on a family vacation and out of State and is not available the week of October 9, 2006, through October 13, 2006. Assistant United States Attorney Gary M. Restaino has indicated that he has no objection to the Motion to Continue. Attorney Restaino did request that Mr. Sloniker's sentencing be set before the sentencing of co-defendant Robert Shinn. Mr. Shinn's sentencing is currently set for November 20, 2006.
