Defendants have today filed (1) a timely Motion for Entry of Judgment as a Matter

16 of Law on the Defamation Claim, and Motion for Remittitur, or Alternatively a New 17 Trial, and (2) a timely Motion to Alter or Amend the Judgment. Insofar as these motions 18 seek relief under Fed. R. Civ. P. 59 and 60, they operate to automatically extend the time 19 for filing a notice of appeal. See Fed. R. Civ. App. P. 4(a)(4)(A). However, the Rules do 20 not explicitly address the effect of asking for a remittitur. Accordingly, in an abundance 21 of caution, defendants file this motion asking the Court to confirm that the time for filing 22

1 a notice of appeal in this case will not begin to run until the Court rules on all issues 2 raised by these motions, including the request for a remittitur. 3 The Court has authority to consider and grant this motion on an ex parte basis.
