Cross-Defendants and Counter-Plaintiff's, Rilwala Group, Inc.; Manu Jogani; Pravin Patel; Paresh Jani; Dinesh Gandhi; Haresh Shah; R.B. Texas Collections, Inc.; Snehal Jani and Rilwala Foods, Inc. ("Rilwala Defendants") by and through their attorneys, Richards, Ralph & Schwab, Chartered, hereby moves the Court to correct the docket and in support thereof state as follows: 1. On June 23, 2005, attorneys, David J. Schwab, Michael L. Ralph, Sr. and

Lauren B. Schreeder, attorneys with the firm of Richards, Ralph & Schwab, Chartered were granted admission pro hac vice to be appear before this Court and on June 27, 2005, filed their Supplemental Appearance as counsel for the Rilwala defendants herein, solely with regard to their Cross-Claim against Amit Patel and Anar Enterprises, Inc. and the corresponding Cross-Claim by Amit Patel and Anar Enterprises, Inc. against the Rilwala Group parties. A copy of the Substitution of Attorneys is attached hereto as Exhibit "A". 2. The Substitution of Attorney was not done for purposes of delaying the

prosecution of the consolidated cases and indeed, promptly after substituting in as attorneys in the Anar Enterprises litigation, the Rilwala Group defendants served their answers to the discovery requests of Amit Patel and Anar Enterprises, Inc. The Substitution of Attorneys does not apply to the claims between the Rilwala Group defendants and the Kahala Group plaintiffs. 3. The purpose of this motion is to correct docket entry number 137 to

properly reflect the scope of the June 27, 2005, Substitution of Attorneys. WHEREFORE, Rilwala Group defendants respectfully request the entry of an Order clarifying that the June 27, 2005, Substitution of Attorney relates only to the Rilwala Group defendants Cross-Claims against Amit Patel and Anar Enterprises, Inc. and the corresponding Cross-Complaint by Amit Patel and Anar Enterprises, Inc.
