24 Annette Holt, by and through her attomey undersigned, provides notice to the court of
25 her consent and agreement with counsel for the receiver herein and with counsel for the
26 Security and Exchange Commission that the 57 shares of stock in Zions Bank be sold as noticed.

1 The Zions Bank stock was a gilt to Annette Holt which gift preceded the occurrences
2 which gave rise to the receivership. No funds, direct or indirect, from any investor were used
3 to acquire or preserve the stock. The stock was Annette Holt’s sole and separate property.
4 Apparently at some point in time the stock was placed in the name of the receiver. The parties
5 have further agreed that the proceeds from the sale of the stock will be held pending a
6 determination as to the validity of Annette Holt’s claim for the proceeds and the panties will
7 move toward a resolution within the next several weeks and will determine whether the stock
8 (and its proceeds) are part of the receivership estate or should be turned over to Annette Holt.
9 The parties agreed that by permitting the sale ofthe stock, neither party is admitting the claims
10 of the other.
