Defendants/Counterclaimants.

On July 27, 2005, Plaintiff/Counterdefendant Brown & Bain filed its Motion for Partial Summary Judgment [Docket No. 107].1 That same day, Brown & Bain served its Separate Statement of Facts in Support of Its Motion for Partial Summary Judgment ("Statement of Facts") on opposing counsel and provided a copy to the Court. Nevertheless, the Statement of Facts is not reflected in the Docket. To clarify the record, Brown & Bain has filed its Statement of Facts with the Court. We have apprised Defendants' counsel of the absence of the Statement of Facts from the docket, and they have no objection to the late filing of the Statement of Facts. The Court granted Brown & Bain's Motion for Partial Summary Judgment on February 22, 2006 [Docket No. 146].
