Respondents, by and through undersigned counsel, hereby file this Third

16 Notice of Disclosure in response to Petitioner's July 6, 2005 motion for leave to 17 conduct additional discovery (Docket No. 119). Without waiving or abandoning 18 their timeliness objections set forth in their July 14, 2005 response to Petitioner's 19 discovery motion (Docket No. 131), Respondents hereby submit the affidavit of 20 Betty Davis, Legal Assistant for the Arizona Department of Corrections 21 (A.D.O.C.), to demonstrate that numerous items whose production Petitioner 22 requested no longer exist, due to implementation of Arizona's records retention and 23 disposition schedule. This affidavit has been attached to this notice as Appendix A. 24 Furthermore, in paragraph 9 of her affidavit, Ms. Davis avows that A.D.O.C. 25 would experience great difficulty and expend enormous resources if it endeavored 26 to provide Petitioner with the requested production of documents memorializing 27 the seizure of weapons in Cell Block 6 between May 1981 and January 1984 28
