Glendale Union Highschool 20 Dist. No. 205, No. 03-0060 ("Ramirez I"). The Dismissal Order did not address the related 21 action, Ramirez v. Glendale Union Highschool Dist. No. 206, No. 04-2909 ("Ramirez II"), 22 but only the merits of the Motion For Summary Judgment, which was filed in Ramirez I 23 before consolidation. On September 27, 2006 Defendants filed a proposed form of judgment 24 in favor of Defendant Glendale Union High School District, as well as other individual 25 defendants. (Doc. #136). On October 11, 2006 Plaintiff objected to the form of judgment 26 on the basis that it seeks to enter judgment in favor of individual defendants named in 27 28

Ramirez II, but not named in Ramirez I. (Doc. #136). Plaintiffs are correct. Judgment will only be entered against those individuals named in Ramirez I. The parties are directed simultaneously brief whether Ramirez II survives in light of the Ramirez I dismissal no later than November 1, 2006. No response will be permitted absent further order of the Court.

Accordingly, IT IS ORDERED that the parties shall file simultaneous briefing on the issue set forth above on or before November 1, 2006.
