Petition to Revoke Probation
COMES NOW PROBATION OFFICER David Gardner presenting an official report on Robert
Bryan Williams who was placed on probation on August 4, 2004, by the Honorable James A. Teilborg
presiding in the District Court of Arizona. A five year period of probation was imposed. _
On February 5, 2008, following revocation proceedings, Williams was reinstated on probation. in addition
to the general terms and conditions adopted by the court, the offender was ordered to comply with the
following special conditions: I
1. You shall participate as instructed by the probation officer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost of
treatment in an amount to be determined by the probation officer.
2. You shall submit your person, property (including but not limited to computer, electronic devices,
and storage media), residence, office, or vehicle to a search conducted by a probation officer, at
a reasonable time and in a reasonable manner.
3. You are prohibited from making major purchases, incurring new financial obligations, or entering
into any financial contracts without the prior approval of the probation officer.
4. You shall participate in a mental health program as directed by the probation officer which- may
_ include taking prescribed medication. You shall contribute to the cost oftreatrnent in an amount
to be determined by the probation officer.
5. You shall reside in and successfully complete a residential treatment program for 6 months.
Robert Bryan Williams was convicted of Possession of Counterfeited Security of State: 18 USC § 513(a),
a Class C felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. Violation of Standard Condition #9: "You shall not purchase, possess, use, distribute or
administer any narcotic or other controlled substance as defined in section 102 of the
Controlled Substances Act (21 U.S.C. § 801) or any paraphernalia related to such
substances, without a prescription by a licensed medical practitioner. Possession of
controlled substances will result in mandatory revocation of your term of supervision?
1) The offender used methamphetamine on or about January 25, 2008, as evidenced by the Kroll
Laboratory Drug Test Report. A Grade C violation. § 781. 1(a)(3).

2) The offender used methamphetamine on or about l\/larch 3, 2008, as evidenced by the Kroll
Laboratory Drug Test Report. A Grade C violation. § 7/31. 1(a)(3).
B. Violation of Special Condition #1: "You shall participate as instructed by the probation
officer in a program ofsubstance abuse treatmentwhich may include testing for substance
abuse. You shall contribute to the cost of treatment in an amount to be determined by the
probation 0fficer."
l 1) The offender failed to provide a urine sample at the TASC facility on February 11, .2008, as
evidenced by the attached Urinalysis Incident Report. The probation officer will testify that the
offender subsequently failed to provide a urine sample at TASC on February 15, 2008, as
directed. A Grade C violation. § 7B1.1(a)(3).
2) The offender began residential substance abuse treatment at Maverick House on April 29, 2008,
and was unsuccessfully discharged on l\/lay 2, 2008, for "non—compIiance with program rules." A
Grade C violation. § 7B1.1(a)(3).
AFFIDAVIT AND PETITION PRAYING THAT THE COURT WILL ORDER A WARRANT BE ISSUED
In conformance with the provision of 28 U.S.C. § 1746, I declare, under penalty of perjuiy, that the
foregoing is true and correct to the best of my knowledge. Based on the information presented that the
offender has violat conditions of supenrision, I am petitioning the Court to issue a warrant.
