CR 03-804 PHX-DGC ORDER

Defendant Frank Pellegrino has filed a Motion for Speedy Trial or for Dismissal of Charges and a Petition for Interstate Agreement on Detainer and Speedy Trial Act or Dismissal of All Charges. Dkt. ##174, 175. Defendant asks that he either receive a speedy trial on the charges in this case or that the charges against him be dismissed. Defendant currently is housed in a federal correctional facility in New Jersey. In responding to the motion and petition, the Government states that it has filed a federal writ for transfer of Defendant to this District so that he may receive a trial on the charges against him. Dkt. #176. In light of this response by the Government, Defendant's motion will be denied. IT IS ORDERED that Defendant's Motion for Speedy Trial or for Dismissal of Charges (Dkt. #174) and a the Petition for Interstate Agreement on Detainer and Speedy Trial Act or Dismissal of All Charges (Dkt. #175) are denied.
