CISNEROS, et al., Defendants. ________________________________________________________________________ CASE SUMMARY This case involves what is known as a RICO prosecution. "RICO" stands for Racketeering Influenced and Corrupt Organizations. The government has alleged that the defendants were operating as a group and committing various crimes together on the group's behalf. The crimes alleged by the government include dealing in methamphetamine, cocaine, and marijuana, and stealing automobiles and switching their VIN numbers to conceal the thefts. The government also alleges that some of the defendants committed murders in New Mexico, and that some defendants committed murder in Arizona. The government further alleges that some defendants conspired to commit the murder of a police officer in Arizona, although no such murder actually occurred. The defendants have pled Not Guilty to all of the charges. With respect to four of the defendants, if they are convicted of intentional and premeditated murder, the jury will be required to decide whether the appropriate penalty is death or a sentence of life imprisonment without the possibility of release. For defendants convicted of intentional and premeditated murder, the government asserts that the death penalty is the appropriate sentence. The defendants deny that the death penalty is the appropriate sentence.

DEATH PENALTY As noted above, the charges in this case against some of the defendants carry a possible penalty of death or life imprisonment without the possibility of release. If and only if the jury finds a defendant guilty of an offense for which the death penalty may be imposed, will the jury then have the task of deciding the penalty.

In cases where the penalty will be decided by the jury, the law provides for a twostage trial. During the first stage, the jury will determine whether the defendants are guilty or not guilty of one or more of the offenses charged in the indictment. If a defendant is found guilty of an offense for which either the death penalty or life imprisonment without the possibility of release may be imposed, the trial will move into a second stage where the jury will decide the sentence. During this second stage the jury will be instructed to consider certain circumstances, known as "aggravating" and "mitigating" factors. The word "aggravate" means to "make worse" or "intensify." Aggravating factors, therefore, are circumstances that tend to support the imposition of the death penalty. The word "mitigate" means to "make less severe" or "moderate." Mitigating circumstances may include aspects of the defendant's character and background, circumstances of the offense, or any other relevant fact that would tend to support a sentence of life imprisonment without the possibility of release rather than the death penalty. If the trial reaches the second stage, the government will present aggravating factors in support of its position that the defendant should be sentenced to death. The defendant may present mitigating factors in support of his position that the appropriate penalty is life imprisonment without the possibility of release. The law governing the death penalty is that no juror is ever required to vote for a death sentence. After hearing and considering the aggravating and mitigating factors, if every juror is not satisfied that the death penalty is the proper sentence, the sentence will be life imprisonment without the possibility of release. The jury may return a death sentence only if every juror concludes that the death penalty is justified based upon the facts and the law as instructed by the Court. The Court will sentence the defendant according to the jury's decision. In any case where the jury must consider death as a possible penalty, the law requires that the jurors answer questions regarding their thoughts, feelings, and opinions about the possible penalties. This is true even though the defendant might be found not guilty and the trial might never reach a second stage. You must not assume from any question that any of the defendants will be found guilty of a crime, nor if found guilty that a death sentence is required by law. Set forth below are a number of questions that are intended to allow you to describe your thoughts and feelings about the death penalty and other penalties.
