Cisneros, et al. 13 Defendants. 14 15 At a hearing on July 29, 2005, the Court indicated that in order to facilitate a fair and 16 efficient jury selection process it would compile a list of objective criteria regarding 17 categories of hardship. The Jury Administrator would excuse potential jurors who met these 18 objective criteria, with the Court making the determination with respect to potential jurors 19 whose claims of hardship fell outside the objective categories. 20 The Court also indicated that it would provide these criteria to counsel, and 21 Defendants have filed a motion seeking, inter alia, "expedited distribution" of the criteria. 22 (Dkt. 1234.) This Order enumerates the Court's objective hardship criteria. 23 First, the Court notes that the District's Jury Selection Plan establishes three categories 24 of "persons [who] shall, upon individual request, be excused from jury service." General 25 Order 04-20, December 1, 2004, at 5. These are (1) a person over 70 years of age; (2) a 26 person who has served as a grand or trial juror within the last two years; and (3) voluntary 27 service personnel. (Id.) These criteria are already in place, and will be utilized by the Jury 28

Administrator in this case. In addition to these categories the Court authorizes the Jury Administrator to excuse prospective jurors who meet the following objective criteria for hardship: 1. 2. Full-time wage earners who will not be compensated by their employers. Full-time self-employed individuals whose regular work hours include the hours of 9:00 a.m. to 2:30 p.m. Tuesday through Friday. 3. Sole caretakers of pre-school age children or of other individuals, including elderly persons, who require extensive supervision. 4. Individuals who suffer from documented medical difficulties and for whom jury service would impose an undue risk of physical or psychological harm. 5. Special education teachers, or other teachers for whom a comparable substitute is not reasonably available. 6. 7. 8. A parent who home-schools his or her children. Full-time students. Individuals who have no access to transportation, including public transportation. 9. Individuals who live a distance of 60 miles or more, one-way, from Phoenix, and cannot stay overnight in Phoenix because they have minor children at home.
