UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America, NO. 02-0123 M Plaintiff, v. Gary James Baldwin, Defendant. The United States of America, by and through its attorney undersigned, hereby moves the Court for an order pursuant to Rule 48(a), Fed. R. Crim. P., dismissing the complaint filed in this matter on June 21, 2002, and ask this court to quash the arrest warrant, which was requested at that time. The basis for the government's motion lies in the fact the defendant was arrested in Kauai, Hawaii on July 22, 2002. It is not expected that excludable delay under 18 U.S.C. § 3161 will occur as a result of this motion or an order based thereon. Respectfully submitted this 2 nd day of October, 2006. PAUL K.
