As the Court is aware, all the other claims and counterclaims previously asserted in this matter have been resolved by settlement. Further, as indicated in the Status Report the Court properly has jurisdiction over this matter. Discovery on these remaining counts has been completed and there are no pending motions that require determination prior to trial of this matter. Therefore, Plaintiff
