The Nelcela Parties' Response is telling. The last thing they want is for the Court

21 to hear the opinions of an actual computer scientist regarding the creativity expressed in 22 the Lexcel Source Code. The live testimony of Lexcel's expert witness, Dr. David Posner, 23 will greatly assist the Court in understanding the considerable creativity expressed in the 24 Lexcel Source Code.
