United States of America, CR-02-088-PHX-ROS Plaintiff, v. Carissa Rayann Whitebread, Defendant. MEMORANDUM RE: STATUS OF CASE PENDING ADMIT/DENY PROCEEDINGS

The United States of America, by and through its attorneys undersigned, respectfully seeks to advise this Honorable Court regarding the present status of this case. The parties received the relevant transcripts today in the early afternoon and have consulted. Defense has advised that defendant will seek to make an admission, with no agreements, during the upcoming admit/deny proceeding set for Monday, December 18, 2006, at 9:30 a.m. In light of the Court's prior statements regarding the commission of any new violations while the defendant was on supervised release, the government has agreed that no agreements prior to disposition are appropriate in this case at this time. The government notes that this Court has been extremely lenient with this defendant to date and that defendant's latest conduct does not appear to merit such leniency at present.
