Instructions for completing Declination
(NHJB-2123-P) Form use. This form is used if the person who is named in the will to serve as the executor of an estate or trustee of a testamentary trust does not wish to serve. A declination may not be filed if there are no estate assets. Top part of form ·COURT NAME: Enter the name of the county probate court where the document will be filed. (example: Belknap County Probate Court; Rockingham County Probate Court). ·CASE NAME: Enter the name of the deceased (example: Estate of John Adams; Estate of Susan Jones). ·CASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. Main part of form 1. Named fiduciary is the person named in the will to serve as administrator, executor or trustee, but who does not wish to serve in that capacity. Also fill in that person's telephone number and complete mailing address with zip code. 2. If there is another named fiduciary who does not wish to serve, enter the second person's name, telephone and address information under #2. Deceased name is the name of the person who died. Also fill in that person's date of death as it appears on the death certificate, and the city or town where they last lived. Signature Section Each person declining must sign the form on the NAMED FIDUCIARY line, and date it in the appropriate space to the left. If there are two persons declining to serve as executor, both must sign and date the form.
