Miller) THE UNITED STATES, ) ) Defendant. ) ____________________________________) DEFENDANT'S LIST OF TRIAL WITNESSES Pursuant to Appendix A, ¶ 15(a) of the Rules of the United States Court of Federal Claims, and this Court's June 1, 2005 Order, defendant, the United States, respectfully submits this list of the witnesses who defendant expects to call or may call at trial for casein-chief or rebuttal purposes. The only witness that defendant expects to call is Larry Tatem, the Defense Contract Audit Agency ("DCAA") auditor who prepared the audit report on the certified claim submitted by plaintiff International Data Products Corporation ("IDP"). Mr. Tatem is expected to testify about his attempts to obtain documents from IDP that would support IDP's claim for costs that it allegedly incurred to perform warranty services after the Desktop V contract was terminated. Mr. Tatem will also present his expert opinion as an auditor about how IDP should have recorded and calculated its alleged costs, and why the DCAA audit report questioned in its entirety the warranty costs that IDP seeks to recover.
