STIFULATION AND PROPOSED ORDER
WHEREAS, under the Court’s Scheduling Order dated November 6, 2006
(DJ. 83) bifurcating the contract and patent infringement issues, discovery on the contract issues
has been completed and the time for tiling case dispositive motions on the contract issues is at
hand (see Stipulation and Order (D.I. 105));
WHEREAS, the parties have been discussing the resolution of this litigation;
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and
between the parties, subject to the approval of the Court, that the date for submission of case
dispositive motions on the contract issues shall be extended from July 3, 2007, to be due gg
0 August 2, 2007. The remaining dates in the case schedule shalt remain unchanged.
