MOTION FOR ISSUANCE OF SUBPOENAS IN FORMA PAUPERIS

The above named defendant moves the court that a subpoena be issued and sewed for the material witnesses hereinafter mentioned, without the prepayment of fees therefor, and that payment of the fees for service and the fees for witnesses be made by the government and taxed as costs in favor of
the United States.
That as indicated in the affidavit for the appointment of counsel it appears that the defendant is without sufficient means and actually is unable to pay the fees for the service of the witnesses and the witness fee, or give security therefor. That the names and addresses of each of the witnesses and short statement of the testimony which each witness is expected to give if subpoenaed, and the showing that the evidence of the witnesses is material to the defense, is set forth in Appendix A hereto attached and made part of hereof. That the evidence of the witnesses is material and the defendant cannot safely go to the motions hearing scheduled for October 19,2007, without the said witnesses.
