Dear Ros:
Thank you for your voice message this afternoon concerning several outstanding issues. I
returned your call right away on your cellphone, but was unable to reach you. I will therefore
send a quick note summarizing the status of our most recent communications about the post trial
damages report and hearing.
In my letter dated September 12, 2007, I reiterated your verbal commitment to Judy and
me to send documentation about Mr. Jung’s current job benefits and salary, and current medical
restrictions. According to your voice message today, you are in hearings this week, but will
provide that information. Because that information is critical to our being able to prepare the
joint statement (due in three days) and has been outstanding for some time, I hope you can
provide that information by noon tomorrow.
I assume that the format I proposed (via e—mail) on August 14, 2007 is the one we will be
using as I have not heard anything to the contrary from you. For your convenience, I have
included a hard copy of that format and my e-mail dated August 14, 2007. I understand that you
should be able to provide a draft by Thursday.
Finally, it appears from the Court’s minute entry that the October 15, 2007 hearing is not
evidentiary, but rather a status hearing. I expect that the Court will want to address matters
about how to proceed with the evidentiary hearing, including the anticipated length of the
hearing, and the presentation of evidence, including exhibits.
