The defendant is participated in an evaluation with Dr. Hollebeek. The report was due no later than June 12, 2006. Counsel advises the Court that Dr. Hollebeek has met with the defendant but that his report is not yet complete. IT IS ORDERED that Dr. Hollebeek will file a report with the Court by Monday, June 26, 2006, explaining why he did not comply with our order of April 24, 2006; and to show cause why his fee should not be cut in one-half. Defendant orally moves to continue the trial date to allow more time to prepare for trial. The oral motion is granted. The Court specifically finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial. This finding is based upon the Court's conclusion that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. §3161(h)(8)(B)(iv). Trial is reset to September 6, 2006 at 9:00 a.m. Status Hearing is set for July 18, 2006 at 4:00 p.m. Excludable delay pursuant to 18 U.S.C. §3161(h)(8)(A) commences on June 27, 2006 for a total of 72 days.
