On December 18, 2006, Petitioner/Defendant (Defendant) filed a Petition Requesting the Status of this case. (Dkt. 33). A status hearing was held August 17, 2006, with the Government and appointed counsel appearing telephonically. On August 18, 2006, the Court granted Defendant's Motion to Vacate, Set Aside, or Correct Sentence pursuant to 28 U.S.C. § 2255 (Dkt. 13) "to the extent that Defendant's Conviction (Dkt. 11) is vacated." Accordingly, IT IS ORDERED granting Defendant's Petition (Dkt. 33) for a Status Report; any other request in the Petition is denied as moot. DATED this 12th day of January, 2007.
