Pending before the Court are Respondents' Motion for a Status Hearing [Doc. No. 121], and Respondents' Motion to Withdraw Exhibits [Doc. No. 171]. Respondents' Motion for a Status Hearing must be denied as moot because the Court has scheduled a status hearing for August 11, 2005 at 9:00 a.m. Further, Respondents' Motion to Withdraw Exhibits shall be granted as, absent objection, Respondents may freely amend their exhibit list. Here, Respondents seek to withdraw several exhibits in light of this Court's rulings on Respondents' Motions in Limine and Petitioner's decision not to call Lino Flores or Larry Joseph Prince as witnesses at the evidentiary hearing. Respondents' may do so, and are advised that any future amendments to the parties' Joint Notice Re: Exhibits [Doc. No. 164], may be accomplished by notice rather than motion.
