UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America CR-03-730-PHX-SRB Plaintiff, v. Luis Cisneros, et al., Defendants. THE UNITED STATES OF AMERICA opposes the Petition for Writ of Habeas Corpus UNITED STATES' RESPONSE TO PETITION FOR WRIT OF HABEAS CORPUS AD TESTIFICANDUM

12 Ad Testificandum filed by the defense after business hours on Friday, October 21, 2005. (Dkt. 13 1305). 1/ The Petition seeks the production of a prospective witness currently housed in the 14 Arizona Department of Corrections. The prospective witness is the individual identified as 15 "Source II" in the affidavit for CWT-215. See CWT-215 Aff. at 27-28 and 31-32. 16 This Court should deny the Petition because the prospective witness' testimony is not 17 allowed under controlling Ninth Circuit law. The hearing scheduled for Tuesday, October 25, 18 2005, is not a Franks hearing. Rather, it is a hearing solely on the legal question of whether 19 the "necessity" showing in the affidavits satisfied 18 U.S.C. ยง 2518(1)(c) and (3)(c). See Order 20 dated Aug. 3, 2005 (Dkt. 1174). Consequently, the Court's review is limited to the facts set 21 forth in the "four corners" of the two affidavits in question. See United States v. Gonzalez, 412 22 F.3d 1102, 1112 (9th Cir. 2005); United States v. Shryock, 342 F.3d 948, 976 (9th Cir. 2003); 23 United States v. Bennett, 219 F.3d 1117, 1121 (9th Cir. 2000); United States v. Meling, 47 F.3d 24 1546, 1552 (9th Cir. 1995). Accord United States v. Nelson-Rodriguez, 319 F.3d 12, 33 n.3 (1st 25 Cir. 2003); United States v. Oregon-Cortez, 244 F.Supp.2d 1167 (D. Colo. 2003).
