15 seal. On May 31, 2005, the Court ordered plaintiff to file a proper response to the summary judgment 16 motion by June 28, 2005. Plaintiff has neither filed a response nor an extension request. According to 17 LR Civ. 7.2(i), "if the opposing party does not serve and file the required answering memorandum. . . 18 such non-compliance may be deemed a consent to the denial or granting of the motion and the Court 19 may dispose of the motion summarily." 20
It is therefore requested that the Court enter an order that based upon the United States' summary
