Based on this Court's Minute Order dated February 21, 2008 allowing each party leave to "proffer one expert's testimony," on the issue of analytic dissection, Nelcela hereby notifies the Court of a conflict and asks the Court to reschedule the March 6, 2008 oral argument. Nelcela's analytic dissection expert, Jeffrey Pell, cannot be available on March 6th due to a pre-scheduled medical surgery. Mr. Pell and Nelcela will be available after March 10th, Mr. Pell's anticipated date of return to work post-procedure. Nelcela also avows that it discussed this matter with opposing counsel for the Post
