In response to your order dated June 23, 2006, I submit the following:
Following my evaluation of Mr. Pedro, [placed a courtesy call to Mr. Navidad to
indicate what the findings of my report would be in accordance with the court’s order for
assessing competence. Mr. Navidad indicated that he had also wanted me to address a
potential factor of mitigation. In that I had not addressed this issue (which was not in the
c0urt’s order for competence), Mr. Navidad suggested he would try to petition the court
for an additional meeting with Mr. Pedro to interview him specifically about the
mitigation issue. I informed Mr. Navidad that I would wait to hear back from him.
Subsequently, I spoke with Mr. Navidad in the past week just prior to the hearing.
At that time I informed Mr. Navidad I could have a report to him by the end of this week. .
Our previous telephone conversation was not discussed.
I believe there is or was a mistmderstanding between Mr. Navidad and myself. As l
indicated, I can have a report to the court by the end of this week. I trust this is in
compliance with the court’s request/order. Should you have any further questions, please
call.
